User Agreement

The User Agreement (hereinafter referred to as the “Agreement”) establishes the terms of use for the daisy.travel service and constitutes a public offer by Individual Entrepreneur Vitalii Ievpak (hereinafter referred to as “Daisy Travel”) in accordance with Part 2 of Article 642 of the Civil Code of Ukraine. This Agreement is addressed to a legally capable individual who has reached the age of 18 and uses the daisy.travel service to purchase a Ticket for an Event under the terms outlined below (hereinafter referred to as the “Buyer”).

Terms and Definitions

Acceptance — The complete and unconditional acceptance by the Buyer of the terms of this Agreement, effected by commencing use of the Service, regardless of whether registration or placement of an Excursion has occurred.

Service — The software system operated by Individual Entrepreneur Vitalii Ievpak, comprising the website at daisy.travel, designed for the placement, search, booking, and purchase of Tickets.

Excursion — A cultural-educational event, guided tour, workshop, or other event format.

Event — An Excursion conducted by a specific Organizer at a designated time, date, and location.

Excursion Page — An Organizer’s offer containing key details about the Excursion offered for sale.

Catalog — A section of the Service containing information about the content and cost of Organizers’ Excursions.

Ticket — A document in electronic-digital form certifying the holder’s right to attend an Event.

Order — The Buyer’s request for booking and/or purchasing a Ticket, submitted through the Service.

Organizer — An individual, legal entity, or individual entrepreneur using the Service to list Excursions and conduct Events.

User — Any individual using the Service.
Participant — An individual attending an Event based on a Ticket.

Content — Any objects posted on the Service, including text, comments, design elements, graphic images, illustrations, videos, photographs, etc., the exclusive rights to which belong to Ievpak, Organizers, or other rights holders.

Profile — The Buyer’s account on the Service, providing access to specific functionalities.

Registration — The established procedure, upon completion of which the Buyer gains access to a Profile.
Policy — The document titled “Personal Data Processing and Protection Policy,” available at  https://daisy-tour.com/personal-data-policy.

1.1. Daisy Travel grants the Buyer the right to use the Service under a simple (non-exclusive), royalty-free license in accordance with this Agreement.

2.1. Daisy Travel acts as an information intermediary. Information about Excursions on the Service is provided by Organizers.

2.2. Daisy Travel provides Buyers with the opportunity to:

2.2.1. Select an Excursion from the Catalog;

2.2.2. Enter into a service agreement for conducting an Event between the Organizer and the Buyer in accordance with the terms of the Public Offer (available at https://daisy.travel/public-offer/);

2.2.3. Receive various notifications from Daisy Travel and the Organizer;

2.2.4. Pay the full or partial cost of a Ticket for an Event;

2.2.5. Leave a review about an Excursion;

2.2.6. Utilize other functionalities of the Service.

2.3. Daisy Travel is not a party to the service agreement between the Organizer and the Buyer and does not provide Excursion services itself.

2.4. Daisy Travel offers assistance and informational support, including addressing Buyer complaints regarding the Organizer or the quality of the Excursion.

2.5. For questions related to Excursion details, the Buyer must contact the Organizer directly. If the Organizer fails to respond within three calendar days, the Buyer may contact Daisy Travel Support Service. Failure to make such inquiries indicates that the Buyer has reviewed and understands sufficient information about the Excursion.

2.6. Daisy Travel reserves the right to:

2.6.1. Modify, enhance, and update the Service without the Buyer’s consent or prior notification;

2.6.2. Impose any restrictions on the use of the Service;

2.6.3. Collect, systematize, and process anonymized data on Buyer behavior on the Website to improve the Service’s quality;

2.6.4. Collect, select, and publish reviews (comments) on the Service and external platforms, determining their relevance and duration of display;

2.6.5. Refuse to publish or remove reviews unrelated to the Service’s theme or lacking useful information for other Buyers.

2.7. Daisy Travel may conduct maintenance work without notifying the Buyer, potentially suspending the Service for up to 24 consecutive hours.

2.7.1. For longer maintenance periods, Daisy Travel shall notify the Buyer in advance via any feasible means, including posting information on the Service’s page.

2.7.2. The Buyer may not claim compensation for losses due to temporary suspension of access to the Service during maintenance.

3.1. To access a Profile, the Buyer must complete Registration.

3.2. For Registration, the Buyer shall provide complete, accurate, and legally compliant information about themselves.

3.3. Daisy Travel stores and processes the provided personal information in accordance with the Policy.

3.4. All actions performed by the Buyer on the Service are deemed to be carried out by the Buyer personally or their authorized representative.

3.5. The Buyer must notify Daisy Travel of any loss of Profile access within 24 hours of becoming aware of such loss.

3.6. Daisy Travel may refuse Registration if the Buyer fails to comply with the terms of this Agreement.

4.1. The Buyer may register:

4.1.1. Via the “Registration” tab in the Service interface;

4.1.2. During the Event booking process;

4.1.3. When contacting an Organizer;

4.1.4. By completing a form to receive promotional mailings;

4.1.5. Or through any other method offered by the Service.

4.2. Upon completion of Registration, Ievpak notifies the Buyer of Profile creation.

4.3. Subsequent access to the Profile requires the Buyer to enter a login and password.

4.4. Daisy Travel may verify the information provided by the Buyer and/or request additional details. The Buyer must provide such details within one business day of receiving the request.

4.4.1. If Daisy Travel determines that the Buyer provided inaccurate or incomplete information, it may block the Profile until the circumstances and reasons for the discrepancy are clarified.

5.1. Before booking an Event, the Buyer must review all information provided on the Excursion Page.

5.2. For questions about Excursion details, the Buyer should contact the Organizer. If no response is received within three calendar days, the Buyer may reach out to Daisy Travel Support Service.

5.3. To place an Order, the Buyer:

5.3.1. Selects an Event on the Service;

5.3.2. Clicks the “Book Now” button;

5.3.3. Completes the Order form with current and accurate data (Buyer’s details, email, phone number, etc.);

5.3.4. Pays for the Order per the terms specified on the Service.

5.4. By submitting an Order, the Buyer confirms awareness of and agreement to:

5.4.1. The Organizer’s name and address (location);

5.4.2. The Event’s date and location;

5.4.3. The Ticket price and payment conditions;

5.4.4. The terms of service provision.

5.5. Upon receiving the Order, Daisy Travel confirms it via email and/or the Buyer’s Profile. At the Buyer’s request, Daisy Travel may amend Order details.

5.6. Daisy Travel sends notifications regarding the Order status and updated details to the Buyer and Organizer via email and/or the Profile.

6.1. Exclusive rights to the Service belong to Daisy Travel.

6.2. Daisy Travel represents that it:

6.2.1. Holds the necessary rights to grant usage of the Service;

6.2.2. Does not infringe upon the intellectual or other rights of third parties.

6.3. Daisy Travel takes all reasonable measures to ensure the security of user data, continuous access to the Service, and its stability and performance.

6.4. Daisy Travel may implement technical measures to protect copyrights and personal data, automatically preventing unauthorized use of Service elements and/or breaches of this Agreement.

6.5. The Buyer represents that:

6.5.1. They are familiar with the Service’s functionalities and purpose;

6.5.2. If acting on behalf of a legal entity or individual entrepreneur, they have the authority to perform actions, including Registration and Service use;

6.5.3. The information provided during Registration and in the Profile is accurate and complies with Russian Federation legislation;

6.5.4. They do not infringe upon the intellectual or other rights of third parties.

7.1. The Buyer may not use Content without prior consent from the rights holder.

The Buyer is prohibited from:

7.2. Using the Service in ways prohibited by Ukraine legislation or not stipulated in this Agreement;

7.3. Attempting to access another User’s personal information by any means, including deception, abuse of trust, or unauthorized access;

7.4. Taking actions, including technical measures, aimed at disrupting the Service’s normal operation;

7.5. Using technical tools to collect or process Service information, including other Users’ personal data;

7.6. Attempting to bypass technical restrictions on the Service;

7.7. Copying, modifying, creating derivative works, decompiling, disassembling, attempting to access source code, or otherwise altering the Service;

7.8. Misleading other Users or Daisy Travel, including impersonating another person or entity without sufficient authority, including Daisy Travel;

7.9. Using Daisy Travel or third-party logos and/or trademarks without permission;

7.10. Insulting Users or Service administrators, using profanity, or harming their reputation;

7.11. Exhibiting racial, national, or religious intolerance, promoting political parties, terrorism, extremism, drugs, religions, or other topics incompatible with generally accepted moral and ethical standards.

8.1. The Buyer is responsible for their actions on the Service in accordance with Ukraine legislation.

8.2. If the Buyer, without Daisy Travel written consent, copies, modifies, creates derivative works, decompiles, disassembles, or otherwise attempts to access the Service’s source code or alter it, Daisy Travel may demand a fine of 1,000,000 USD per violation.

8.3. If the Buyer breaches representations made under this Agreement or commits any prohibited action, Daisy Travel may demand a fine of 500,000 USD per violation.

8.4. If Daisy Travel receives claims, demands, or lawsuits regarding the Buyer’s infringement of third-party rights via the Service, the Buyer must resolve them independently and compensate Daisy Travel for any resulting damages.

Limitation of Liability

8.5. The Service is provided “as is.” The Buyer acknowledges and accepts risks associated with its use, including risks of obtaining information, data loss, or damage.

8.6. Daisy Travel is not liable for:

8.6.1. Proper execution of the service agreement between the Buyer and Organizer;

8.6.2. Actions or inaction of service providers, networks, software, or equipment;

8.6.3. Any losses resulting from the Buyer’s use of the Service or its components;

8.6.4. Lost data posted on the Service;

8.6.5. Harm to honor, dignity, or business reputation caused by Service use;

8.6.6. Device malfunctions occurring during Service use;

8.6.7. Consequences of the Buyer granting Service access to third parties;

8.6.8. Errors or violations due to improper actions by the Buyer’s staff or third parties;

8.6.9. Third-party actions reducing Internet or Service availability;

8.6.10. Inability to use the Service for reasons beyond Ievpak’s control.

8.7. The Parties are exempt from liability for partial or full non-performance of obligations under this Agreement if caused by force majeure events beyond their control, occurring after the Agreement’s conclusion (e.g., floods, fires, earthquakes, wars, strikes, or governmental actions).

9.1. Upon the Buyer’s breach of this Agreement or Ukraine legislation, Daisy Travel shall issue a demand to remedy the violation and may:

9.1.1. Block access to all or specific Service functionalities;

9.1.2. Block the Profile.

9.2. If the Buyer remedies the violation within three business days of receiving the demand, Daisy Travel restores Profile and/or Service access.

9.3. Daisy Travel may delete or restrict Profile access if:

9.3.1. The Buyer fails to remedy the violation within three business days;

9.3.2. The Buyer requests deletion via support at [insert email, e.g., [email protected]].

9.4. Profile deletion entails:

9.4.1. Daisy Travel’s unilateral termination of the Agreement due to the Buyer’s breach;

9.4.2. Deletion of all data uploaded to the Profile.

9.5. Upon receiving third-party claims or governmental demands, Ievpak may block the Profile until resolution.

10.1. Disputes between Daisy Travel and the Buyer shall be resolved through pre-litigation negotiations.

10.2. Responses to claims must be provided within 30 calendar days of receipt, unless otherwise required by Ukraine legislation.

10.3. Unresolved disputes may be submitted to the court at Daisy Travel’s location.

10.4. Disputes with consumer Buyers shall be resolved judicially per Ukraine legislation.

11.1. The Parties recognize the validity of document signing via scanned copies exchanged through the Profile, email, or electronic document management systems.

11.2. Acceptable communication methods include email, Profile, and electronic document management operators.

11.3. Contact email addresses:

Daisy Travel: As listed in the “Contacts” section of the Service;
Buyer: As provided during Registration or Order placement.
11.4. The Parties must maintain the confidentiality of Profile access credentials, email login, and passwords.

11.5. Information and document exchanges via email, Profile, or electronic systems hold legal force, including in judicial proceedings.

11.6. Daisy Travel may send messages, notifications, requests, and informational content related to the Service and Excursions to the Buyer’s Profile, email, or phone number.

12.1. For issues related to Service functionality, the Buyer may contact Daisy Travel via the email listed in the “Contacts” section.

12.2. Inquiries must include all necessary information for resolution, including Buyer identification data.

12.3. Daisy Travel processes inquiries in the order received, with response times varying by inquiry nature and volume.

12.4. Daisy Travel does not provide consultation on matters unrelated to the Service or requiring professional expertise beyond its scope.

12.5. Daisy Travel may decline to address inquiries:

12.5.1. Lacking necessary information;

12.5.2. Containing false information;

12.5.3. Lacking credibility;

12.5.4. Repeating previously answered questions;

12.5.5. Containing insults, threats, or sharply negative language;

12.5.6. Submitted in violation of this Agreement’s inquiry procedures.

13.1. This Agreement takes effect upon the Buyer’s Acceptance and remains in force until the Buyer ceases using the Service.

13.2. Daisy Travel may unilaterally amend this Agreement, notifying the Buyer via the Service or email.

13.3. Amendments take effect upon publication on the Service. Continued use of the Service post-amendment constitutes acceptance.

13.4. The Buyer bears the risk of failing to review the amended Agreement.

13.5. If any provision is deemed void under Ukrainian law, the remaining provisions remain enforceable.

14.1. For Events involving museum-organized spectacles, the Buyer and Service agree to a mandate contract under Article 1000-1010 of the Ukrainian Civil Code with the following terms:

14.1.1. The Buyer (Principal) entrusts, and the Service (Agent) undertakes, for a fee, to purchase Tickets on the Buyer’s behalf for museum events;

14.1.2. The mandate must be fulfilled by the Event date specified in the Order, with rights and obligations arising directly for the Buyer;

14.1.3. The Service shall execute the mandate per the Buyer’s instructions and deliver the Ticket by the Event date;

14.1.4. The Buyer must provide required details upon the Service’s request;

14.1.5. The Service may refuse the mandate if details are not provided or Tickets are unavailable, with refunds per the Public Offer;

14.1.6. The Service’s fee, including all costs, is paid by the Buyer prior to mandate execution.

14.2. If an Organizer cancels an Event or the Buyer cannot attend a paid Event, Ievpak may replace it with another Event upon Buyer agreement.

14.3. Excursion cancellation terms are governed by the Refund Rules (https://daisy-tour.com/vozvrat).

14.4. Personal data processing and protection are governed by the Policy.
